So Why Were the Yongzh’s Emulators Pulled?

There was much sadness when Android developer, yongzh, had his Market account deleted and line of popular game emulators pulled from the market. Many people were troubled by this news, seeing it as Google bowing to pressure from gaming companies. We’ve done a little bit of digging, and it seems that this may be a much simpler case of one developer breaking the law.

After the initial shock of the *oid emulators getting pulled, and then downloading the apks from their temporary home at SlideME to install on any future phones I own, I realized something didn’t add up. There are still tens, if not hundreds of emulators and ROM related apps on the Market. There were rumors swirling about that yongzh may have been banned, not because he was making emulators, but because he was violating open source licenses.
Lets start with some background on emulators. Emulators are a very cloudy subject legally. Trying to find information on the internet on the legality of emulators is actually quite difficult with conflicting reports and vaguely worded statements abounding. This is made that much worse when there are different laws for an emulator itself, and the ROM game images. We can’t condone or condemn emulators, but to the best of my knowledge, there is nothing explicitly illegal about an emulator, as it is usually the ROM itself which is considered to be the intelectual property of the company.

So yongzh’s apps were pulled, and as far as we can tell weren’t illegal, but other emulators remain in the Market. This is what started our looking into a rumor that yongzh was removed from the Market for violating open source licenses. Reports have popped up that snesoid, the Super Nintendo emulator app, was simply a java wrapper for the open source snes9x emulator.
We contacted the founder of snes9x and found out some details. The snes9x project was started in the 90s and is published under a license, which allows it to be copied and used so long as it is not for commercial purposes. While there was discussion on the snes9x forums about reporting yongzh, or even pursuing legal action back in February, we confirmed with the project founder, that he did not personally pursue yongzh.

So where does this leave us? What we know for sure at this point is that yongzh’s emulators were pulled from the market, yet apps which could not be any more legal than his in regards to emulator and ROM laws remain. Google’s response to me asking for details was generic as expected:
As a matter of policy, we don’t provide comment on individual apps or developers. I can confirm, though, that the apps that were removed were in violation of Android Market policies.
This does mean however, that Google had some official reason to remove the apps, or at least yongzh’s account. If this was removal due to infringing video game manufacturer’s intelectual property, it just would have made more sense that the companies claiming IP violation would have spent the time to apply it to other emulators. It seems most likely that either someone took it into their own hands to report yongzh’s use of the open source code, or Google discovered it themselves. Should anymore information come to light we will be sure to update you. In the meantime, continue to love Android and don’t panic just yet that the end of “Openness” is upon us.

PAC-MAN for Android Review [Amazon Free App of the Day]

It appears that BANDAI / NAMCO are making an effort to get into the mobile gaming world today as they’ve both released PAC-MAN for Android exclusively through the Amazon Appstore for free AND have showed up at the Qualcomm (Uplinq) conference alongside other brand giants collaborating with the chipmakers. What we’re looking at here is the PAC-MAN game on a couple of devices of note: the HTC ThunderBolt (because it’s still one of the most widely used devices on the LTE-having market right now,) and the Sony Ericsson Xperia PLAY because we wanted to see if the controls did anything with the game. Turns out they do – sort of.

Once you open this app you’ll notice the BANDAI / NAMCO logo in orange and yellow on white, then the game. Instantaneously and without a wait you’ll be playing PAC-MAN in classic arcade fashion. This app is set up for use on all screen sizes, but once you’ve got it up on a larger tablet, you’ll find that a large black border appears around your game screen. We’re hoping for a tablet-optimized version of the game in the near future.

The reason we ARE looking for an optimized version of the app is because it’s utterly amazing and totally classically worth playing. There’s a single control, that being the virtual joystick that you’re able to control from anywhere on the screen, then a pause screen that you can activate with your back button (or the Circle button if you’re on the Xperia PLAY.) Have a look then go get it for free from the Amazon Appstore!
Check out our Amazon Appstore 101 column for more information on the store if you’re totally unawares!

Archos announcing new generation of Honeycomb Tablets June 23rd

Archos who was one of the first to start making and selling Android tablets back in the Android 1.5 days are about to unleash some information on the next generation of Archos Tablets in Paris come June 23rd. They’ve had some success with Android tablets even though they have not shipped with Google’s blessing and set of special Google Apps such as the Android Market, Gmail, Google Maps and more. Archos has done a pretty good job making older android versions run well on tablets like the Archos 101 and 70.

The above image is not in English, but from what we are hearing it seems that Archos is all set to announce the new line and latest generation of their tablets, hopefully running on Honeycomb at a event on June 23rd. Details are thin, same goes for any news as to if they will actually be running Honeycomb or not but the Bee buzzing around in the picture above makes us think Honeycomb is up next for Archos.
A few Archos devices hit the FCC back in February but I have a feeling those are not what we will be seeing come June 23rd. Archos is known to make extremely reasonably priced devices although some may consider the build quality lacking. Hopefully this next generation will bring Archos up to par with the latest offerings like the Motorola Xoom, and the ASUS Transformer. Stay tuned for more information and check back on June 23rd for more details.

Qualcomm Uplinq 2011 Keynote Details: 3D, Augmented Reality, Peer-to-Peer Gaming

Today Qualcomm was at the Uplinq 2011 Event and started things off this morning on the first keynote with Dr Paul Jacobs, Chairman and CEO of Qualcomm. He was standing in front of a huge screen that showed impressive idea’s, data, and numbers throughout the keynote. Jacobs commented that they’ve learned mobile data is expected to increase and grow by 10-12 fold come 2015 and they plan to be around for it all. He also mentions that Qualcomm’s shipped over 1 Billion devices already. Those are some impressive numbers to start off the day.

They talked a lot about Qualcomm of course, but lots of discussion was also on 3D, Augmented Reality and other forms of media consumption. Nokia, Sony Ericsson and others all had their time on stage, as well as a few folks from Dreamworks to talk about DVDs but I’ll mention more on that later.
CreativeArtistsAgency aka CAA, Qualcomm’s newest partners took the stage next and had some impressive numbers of their own to report, mentioning that over 250 Snapdragon devices are currently under development. If that doesn’t get you excited for the future I don’t know what will. Next up we saw Sony Ericsson take the stage and show us more on that Xperia Play we all know and love.

Sony Ericsson talked briefly about a few of their devices like we mentioned above, as well as the partnership with Qualcomm so we should be seeing more exciting things in the future coming out of team SE. I have a feeling a Sony Ericsson dual-core Snapdragon gaming tablet might be headed our way soon, possibly 3D. Just thought I’d throw that out there.

There was talk about 3D, and the Qualcomm MDP 1.5 Ghz Dual-core platform. They used the MDP device to show some Kung-fu Panda in 3D on the big screen, as well as some Peer-to-Peer gaming done on a HTC Tablet.

Dreamworks was invited on stage via President of Production and Feature Animation, John Batter. He talked a little about Kung-Fu Panda and selling DVD’s using augmented reality and pushing the media consumption idea. He went on to mention Dreamworks pre-selling DVDs and users could order with their device and get custom content right to their phone after making a DVD purchase. Interesting idea’s are floating around that is for sure.

Last but not least here are a few pictures from the big screen we mentioned at first, showing some of those numbers and statistics we talked about earlier.

This is just a small overview of the events on stage as well as pictures for your viewing pleasure. We hope to hear some more exciting news today especially regarding Android so stay tuned for more information.

New NOOK Model Shipping Early

Barnes and Noble’s latest version of their Android based e-reader was announced last week with a ship date of “around” June 10. Today, it appears they were using “around” pretty loosely, as pre-orders have already shipped. Barnes and Noble has said that any other orders placed will continue to ship right away, emphasizing that they will arrive in time for Father’s Day gifts.

The newest NOOK goes back to its e-reader roots. Forsaking the color LCD screen of the NOOKColor, this model features a 6″ e-ink screen, which will allow the Nook to reportedly go 2 months without a charge. Orders are shipping today, but if you want to try out the new e-reader before buying it, demo units will be available in stores as early as tomorrow, and will be for sale in physical stores starting this weekend.
Since this NOOK uses the more energy efficient e-ink technology, it is clearly focused more on the sole purpose of reading. It also means that this model almost certainly won’t have near the developer support that it’s NOOKColor cousin has. It is a great example though of how Android is flexible as an operating system, and not limited to powering phones.
New York, New York – June 1, 2011 – Barnes & Noble, Inc. (NYSE: BKS), the world’s largest bookseller, announced that it began shipping its All-New NOOK yesterday, getting pre-ordered devices to customers well ahead of schedule. New online orders for The Simple Touch Reader are now shipping immediately for delivery in time for Father’s Day and summer reading. Customers visiting one of Barnes & Noble’s more than 700 stores will be able to try live NOOK demonstration units beginning Thursday, and will find product in-stock in stores beginning this weekend.
The All-New NOOK, introduced by Barnes & Noble just last week, is the easiest-to-use, most intuitive eReader available, with best-in-class battery performance of up to 2 months on a single charge. The device is ultra-light and portable and features a 6-inch full touchscreen with the most advanced E Ink Pearl display for crisp, clear reading even in bright sunlight. NOOK customers can access the world’s largest bookstore of more than 2 million books, magazines and newspapers, available via Wi-Fi®. The All-New NOOK is $139 in Barnes & Noble stores and online at www.nook.com.
“We’re excited with pre-order demand for the All-New NOOK to date and are very pleased to deliver this easy-to-use device to our customers earlier than committed,” said William Lynch, CEO of Barnes & Noble. “We welcome customers to visit their neighborhood Barnes & Noble store to learn more about NOOK and experience our new light, portable, touch eReader.”
